Tax prospects.




Results of the discussion of changes in the Tax Code of Ukraine.

On Friday, August 11, the Ministry of Finance of Ukraine discussed amendments to the Tax Code of Ukraine aimed at promoting the development of charitable activities. The meeting was attended by State Secretary of the Ministry of Finance Yevhen Kapinus, representatives of the Tax Policy Department of the Ministry of Finance, Head of the Department of Tax Administration and Individual Taxes and Head of the Profit Tax Methodology Department of the State Fiscal Service of Ukraine, representatives of Plast, Ukrainian Forum of Philanthropists, Ukrainian Independent Center for Political Studies and the Federation of Trade Unions of Ukraine.

The charity sector proposed the following changes: exemption from taxation as an additional benefit of expenses for the organization of events by non-profit organizations (Article 165.1.42); increase in the non-taxable amount of annual charitable assistance for certain categories of persons (Article 170.7.3 of the NKU); exemption from taxation of targeted charitable assistance for treatment (Article 170.7.4 of the Tax Code), provided to the taxpayer on condition of documentary proof of expenses (in the current version of the article we are talking only about health care institutions); exemption of charitable organizations from land tax and property tax, as well as rules for the introduction of interest philanthropy in Ukraine.

Unfortunately, not all of the proposed changes were approved by officials. In particular, it was proposed to finalize proposals for changes in Art. Art. 165.1.42, 170.7.3 of the NKU, as well as to hold a broad public discussion on interest philanthropy and norms related to land tax and property tax benefits.

A positive result of the meeting was the instructions of the Secretary of State of the Ministry of Finance of Ukraine to the Department of Tax Policy to create a thematic working group with representatives of civil society institutions to further work on changes in tax legislation and develop a consolidated position of the state and sector.
